The Federal Trade Commission has delayed by 90 days the implementation of its new rules requiring many businesses, including most dental offices, to create, adopt and follow a written identity theft program. These regulations have become known as the “Red Flags Rule.”
The delay will give the American Dental Association more time to challenge its applicability to small health care providers such as dentists. Whether dentists will still be required to comply with the new Red Flag Rules after the 90-day period is still unknown, so it may still be wise to review the compliance information the ADA and MDA have gathered to help practices begin their compliance efforts.
